Notice periods are the most underestimated variable in Indian hiring plans. A company signs off headcount in April, expects the person at the desk by June, then discovers in May that their selected candidate owes 90 days. The role slips to August, the business case slips with it, and someone asks why recruitment took five months when the offer was signed in six weeks.
This guide covers what governs notice periods in India, typical durations by seniority, how buyouts and garden leave work, what changes between resignation and termination, the awkward reality of absconding employees, and how to plan a pipeline around 60-90 day exits. There is no single national statute setting notice periods for all employees. Three sources interact, and which dominates depends on the employee’s category and your state.
The practical implication: contractual notice binds an employee’s resignation, but it does not override statutory protections when the employer terminates a covered workman.

Notice periods lengthen precisely where replacement is hardest. A 90-day notice on a niche engineering or specialist finance role is not an administrative detail — it is the dominant term in your delivery date.
Buyout means the employee pays their current employer for the unserved notice, usually calculated on basic salary or fixed CTC for the remaining days, and is released early. Three things decide whether it happens: the contract must permit it, the current employer must agree — many now refuse as a retention lever — and someone must pay.
Employers hiring for urgent roles increasingly fund it themselves, either as reimbursement against the relieving letter or as a joining bonus with a 12-month clawback. A 45-day buyout on a ₹24 LPA candidate is roughly ₹3 lakh of gross salary equivalent — significant, but often less than leaving a revenue-owning seat empty for six more weeks. Budget for it at approval stage rather than negotiating under pressure in week ten.
Garden leave keeps the employee on payroll and contractually bound but away from the office, systems and clients for part or all of the notice. It is common at senior level, in banking and financial services, and wherever the person is joining a direct competitor.
For the hiring employer it is worse than a buyout: you wait the full period and the person cannot be released early. Plan the start date on the full term and use the interval — pre-onboarding material, regular contact from the hiring manager, and a 30-60-90 day plan ready on day one.
On resignation, contractual notice binds the employee; the employer may waive it, insist on it, or accept payment in lieu. On employer termination, the analysis shifts: if the employee is a covered workman, statutory notice and compensation apply regardless of the contract. Even for non-workmen, terminating without following your own contractual notice and documented process invites a wrongful-termination claim.
Termination for proven misconduct is a separate route, usually permitting dismissal without notice — but it generally requires a documented domestic enquiry with a charge sheet, an opportunity to respond and a reasoned finding. Skipping the process is where most employers lose these matters, not the underlying facts.
Probation normally carries 7 to 30 days on either side. Two cautions: handle confirmation deliberately, because in several states an employee whose probation lapses without action is treated as confirmed by conduct; and extending probation beyond the contractual maximum can be challenged.
Important: employment law in India varies by state, by employee category and by the exact wording of each contract, and the labour codes are being implemented unevenly across states. Nothing here is legal advice. Before terminating an employee, treating one as absconding, or changing your standard notice clause, confirm your position with a qualified employment lawyer familiar with the state in which the employee is engaged.
An employee stops attending, stops responding, and does not resign. What you can legitimately do: send a written show-cause notice to the last recorded address by registered post and email, allow a reasonable period to respond, follow up with a second notice, document every attempt, and — if there is still no response — treat the matter as abandonment of service through a properly recorded process before removing them from the rolls.
What you should not do: withhold statutory dues such as provident fund or earned gratuity, deduct arbitrary penalties beyond what the contract and the Payment of Wages Act permit, blacklist the individual with other employers, refuse documentation indefinitely, or file a criminal complaint over what is a civil contractual matter. Recovering unserved notice is a civil claim, and at most mid-level salaries the recovery is not worth the litigation cost.
Two documents close the loop. The relieving letter confirms the employee has served or settled notice and stands released from a stated date — most Indian employers and virtually all background verification agencies treat it as proof of a clean exit. The full and final settlement covers unpaid salary, leave encashment, reimbursements and variable due, less contractual recoveries such as notice shortfall or unreturned assets.
As the hiring employer, make the relieving letter an explicit offer condition and ask early whether the candidate expects any difficulty obtaining one. A candidate who quietly cannot produce one for a previous employer will fail background verification in week three — after you have closed the search and released the pipeline.
Notice periods are not an obstacle to work around; they are a known input you can plan for. Employers who capture notice terms at first screening, pre-approve a buyout budget, keep runner-up candidates engaged and start senior searches early consistently hit their joining dates. Those who treat notice as an afterthought spend the last month of every search renegotiating a date they should have set at the outset.
